Terms of Service

1. Agreement to Terms

By accessing or using the services provided by ABM Consulting ("Company," "we," "our"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access our services.

2. Services

ABM Consulting provides the following professional services:

  • CFO/Controller Services and strategic financial leadership
  • Business Advisory and Valuation services
  • Accounting and Financial Reporting (including IFRS compliance)
  • Tax Compliance and Advisory services
  • Business Formation and registration in Kosovo
  • AI Automation Workflows and intelligent process automation

The scope, deliverables, and fees for specific engagements will be detailed in a separate service agreement or engagement letter between ABM Consulting and the client.

3. Professional Standards

Our services are delivered in accordance with applicable professional standards, including International Financial Reporting Standards (IFRS), Kosovo tax regulations, and relevant accounting and auditing standards. While we strive for accuracy and completeness, our advice and reports are based on the information provided to us and prevailing regulations at the time of engagement.

4. Client Responsibilities

As a client, you agree to:

  • Provide accurate, complete, and timely information necessary for service delivery
  • Inform us promptly of any changes that may affect the services being provided
  • Make timely payments for services rendered as agreed upon
  • Maintain the confidentiality of any proprietary tools, templates, or methodologies shared during engagements
  • Use our deliverables solely for their intended purpose

5. Fees and Payment

Service fees are as outlined in your engagement agreement or as listed on our pricing page. Unless otherwise agreed, invoices are due within 15 days of issuance. We reserve the right to suspend services for overdue accounts. All fees are quoted in Euros (EUR) unless stated otherwise.

6. Confidentiality

We treat all client information as strictly confidential. We will not disclose your information to third parties except as required by law, regulation, or professional obligation. This confidentiality obligation survives the termination of our engagement.

7. Intellectual Property

All methodologies, tools, templates, automation workflows, and proprietary processes developed by ABM Consulting remain our intellectual property. Clients receive a license to use deliverables created specifically for their engagement but do not acquire ownership of our underlying intellectual property.

8. Limitation of Liability

To the maximum extent permitted by law, ABM Consulting's total liability for any claim arising from our services shall not exceed the fees paid for the specific engagement giving rise to the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages.

Our services do not constitute legal advice, and we recommend consulting with qualified legal counsel for legal matters.

9. AI Automation Services

For AI automation services specifically, clients acknowledge that:

  • AI outputs should be reviewed and validated by qualified personnel before critical decision-making
  • Automation workflows may require periodic updates due to changes in third-party APIs and platforms
  • We provide ongoing support and optimization as part of our service agreements
  • Performance metrics are estimates based on typical outcomes and may vary by implementation

10. Termination

Either party may terminate the engagement with 30 days written notice. Upon termination, the client shall pay for all services rendered up to the termination date. We will provide reasonable assistance in transitioning services to another provider.

11. Governing Law

These Terms of Service are governed by the laws of Kosovo. Any disputes arising from these terms or our services shall be resolved through the competent courts of Kosovo.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the updated terms.
